organisation number 559249-1400, VAT no. SE559249140001. Kinship Collective registered office is located at Högbergsgatan 62E, Suite 1402, 118 54 Stockholm, Sweden.

These general terms and conditions (the ”General Conditions”) apply when you as a consumer (the ”Customer”) place an order via www.kinship-collective.com and related pages, (the ”Website”). The agreement is concluded between you and Kinship Collective AB, organisation number 559249-1400 (”Kinship”).

Business Policy

Kinship offers products for sale on kinship-collective.com and its e-commerce business services exclusively to its end users, i.e. "Customers". "Customer" shall mean any person who is the final customer, or consumer of the goods. Kinship reserves the right to refuse orders of users who are not "Customers" and any other order which does not comply with the Kinship business policy.  These General Terms and Conditions of Sale exclusively regulate the offer, transmission and acceptance of purchase orders relating to products on kinship-collective.com between the users of kinship-collective.com and Kinship.

Ordering

To place an order through the Website, the Customer must accept the General Conditions.  By accepting the General Conditions, the Customer undertakes to comply with the General Conditions in its entirety and acknowledge that they had read the information on the personal data and cookies and consents to use according to Kinship Privacy Policy available here.

A purchase agreement is concluded when Kinship has confirmed the Customer’s order and the Customer has received an order confirmation from Kinship via email. Kinship recommends saving the order confirmation for any future contacts with Kinship Customer Service regarding the order. The Customer is entitled to cancel their order up until it has been confirmed by Kinship. If the order is cancelled, Kinship will refund any payments to the Customer that they have made with regard to this order.

To purchase at kinship-collective.com you must be at least 18 years old and possess a valid credit card that we accept. If you are not 18 years old, you may still purchase if you have obtained your guardian’s consent and/or otherwise have a legal right to enter into a purchase.

Prices, Fees and Payments

The prices stated on the Website apply to orders placed on the Website. All prices are presented including VAT. The prices do not include payment and shipping fees, which are given separately in the Checkout. Prices are subject to changes. Check the final price of sale before sending the relevant order form.

Purchase orders from countries not included among those displayed in our Delivery Information section cannot be accepted by Kinship.

The Customer can pay for their purchase in the manner specified on the Website.  Read more about our different payment options on the Website here.

The Customer shall select the items they want to buy and put them in their ”Cart”. The content of the Cart can be edited right up to the time of order and the prices of the products are highlighted. Any extra payment such as shipping, tolls or import taxes can be calculated immediately before you are ready to pay. When you are ready to order, complete your name, address, email, telephone number, payment method, and delivery method. You can change the contents of the Cart right up until you confirm your purchase by clicking on the button ”Confirm”. After this your order passes to Kinship and can no longer be changed.

Payments are handled with secure encryption and under strict banking standards. Your card details are sent directly to the bank and cannot be read or accessed by anyone other than your bank.

Discount codes

We occasionally use discount codes as part of our marketing. These codes are valid for limited periods and may be subject to conditions. These codes can be limited for use with specific products, categories or fabrics.

Discount codes should be entered during the checkout process to be valid. Only one discount code can be used per order. Attempting to add a discount code after purchase will not be honoured. Discount codes have no cash value and cannot be redeemed for cash, vouchers or similar.

Kinship Guarantee 

In normal use a Kinship product will last for at least 3 years. This is our promise to you. Our guarantee is valid providing the product was used in a normal home environment and you followed the advice given on our care label found on the product itself.

The guarantee is valid for 3 years from the date you receive your products. If you should discover a defect please contact Kinship customer service and we will handle the guarantee process as quickly as we can. Kinship will correct the defect if possible or produce a new item for you. If we no longer carry the item/fabric you originally ordered, you will receive an equivalent product or your money back. 

Please ensure you comply with the following guarantee conditions:



  •   the products have only been in normal use in a home environment.

  •   the products have been handled according to our care label. 
  •   return shipping costs that may incur will be paid by Kinship and all returns will be handled by the delivery partner indicated by Kinship. 

Cancellation of orders


Kinship may cancel an order if it is not possible to deliver the ordered product. You will be informed if such a situation arises and any payment or reservation made will be returned/cancelled.

When you order a product from Kinship, you will receive a receipt by email to show your order has been received. However, you enter into a binding sales contract only when you have received an order confirmation/sales receipt from us.

If for any reason, you are not satisfied with your order, you may exercise your right to return the products, by contacting Kinship Customer Service within 14 working days from the date on which you received the products purchased on kinship-collective.com. To cancel the contract and return the products you shall use the return form available from our Customer Services.

We expect you to return the product as soon as possible after you have given cancellation notice and no later than 14 days after you have changed your mind. 

To exercise the right to cancel you must:

  • notify Kinship Customer Services within 14 days of the date you received the parcel
  • include a completed copy of the Kinship Return Form with the products
  • pack the products unused, unwashed, and not damaged in their original packaging, and in no more than one parcel
  • return the complete product to Kinship unless otherwise specified by our Customer Services (eg, multi-pack products must be returned with all items included)
  • we recommend that the products are returned by using the same courier/delivery service that delivered the products to you (DPD or DHL). You are responsible for the package/products until received by Kinship. We also recommend keeping the receipt from the courier and if applicable the track and trace number

Kinship must receive the goods within 30 working days of the date you received the parcel.

Refunds

When we receive the product(s), we will check them and you will be refunded the amount you paid to us upon purchase, including the original delivery fee.  The amount is always transferred to the same payment method used for the purchase. 

You may lose your purchase amount, in whole or in part.  This happens if the product is impaired or damaged because:

  •   you have used the products
  •   the products were damaged while you were responsible for them
  •   you have not followed the restrictions of the cancellation rights outlined above

Kinship will refund the amount paid for the products without undue delay, and no later than 14 days from the date Kinship received the customer notification of the cancellation.  However, Kinship may delay the repayment until we have received the product or the customer has provided proof that the product has been returned (eg certificate of delivery).

Delivery Partners: DHL/DPD

Returned products may be shipped by the package delivery company DHL or DPD, as advised by Kinship, using the procedures outlined in the Kinship Help Topics. If you use DHL or DPD, Kinship will pay the shipping costs in case of defective items and to track the package at any time.

If you decide to use a different package delivery company, any costs for shipping the products will be charged to you, and you will be responsible for any loss or damage to the products.

Claims

Your purchase is covered by the Sale of Goods Act, including rules regarding defects.  This means that you can either have a faulty product repaired or replaced, or receive a full refund in price, depending on the specific situation.

Any consumer who wishes to assert their right to file a complaint for any product ordered shall contact Kinship Customer Services, as soon as possible after discovering the defect.  We recommend that you claim as soon as possible within 2 months of the defect being discovered.

There is a 3 year warranty on the goods purchased on the website.

So that we can assess your claim, we ask you the following:

  • Contact Kinship Customer Services at customerservice@kinship-collective.com
  • Send us a brief description of what the damage or defect is/how it occurred, as soon as you discover the defect
  • Include a description of the defect with 4-6 photographs.  The defect must be clear, and one must include a photograph of the entire product as well as the defective portion
  • Indicate the order number, or attach a copy of the order receipt
  • After we receive your photographs, we will handle your claim as soon as possible

If you are returning faulty product(s), Kinship will arrange for the collection of the package, and incur the costs associated with shipping. 

If the claim is justified, we will refund reasonable shipping costs incurred when sending the item back to us. Otherwise you must bear all costs of transport, including our shipping costs for returning the item after the investigation.

The item must always be well packaged and you must retain proof of postage.  You are responsible for the package until it is received by Kinship, so keep the postal receipt including information on the shipping costs and if applicable the track and trace number.

Personal Information

To shop at Kinship you must give the following minimal information:

  •     Name
  •     Address
  •     Email Address
  •     Telephone number

The above data is stored together with information about the products that you have ordered. Information will not be disclosed or sold to third parties, except in connection with a restructuring or a full or partial sale of the company. Any disclosure in such a situation would be in accordance with current privacy legislation. As a customer you are entitled to access your registered data and you may object to registration pursuant to the relevant rules in the Personal Data Act. Intellectual Property Rights

All intellectual property rights, such as trademarks and copyright, on the website and in the material published on it are owned by Kinship. Any use of the site or its content, including copying or storing such content in whole or part, other than for your own personal, non commercial use, is prohibited without permission of Kinship.

By using kinship-collective.com you agree that we may use cookies. A cookie is a small data file that we place on your computer to keep track of what happens during your visit and to recognise your computer. A cookie is not a program and does not contain any viruses.

Force Majeure

Kinship shall be exempt from liability for damages and other penalties on the performance of the contract prevented, hindered or delayed by circumstances beyond our control. The release factors to be considered include government intervention, new/amended legislation, lack of state, fire, flood, labour disturbance, prohibitions, restrictions, acts of war, terrorist attacks, sabotage, poor transport, poor weather conditions, lack of delivery from suppliers, and the company being exposed to criminal activity that affects business activities.

Governing Law

These General Terms and Conditions of Use are governed by Swedish law. Any disputes are decided by the ordinary Swedish courts.

Appeals
If you have a complaint about your purchase, please email customerservice@kinship-collective.com. If we fail to find a satisfactory solution, you can, if the conditions are met, lodge a complaint with the Allmänna Reklamationsnämnden (ARN) (http://www.arn.se/). You may also use the European Commission Online Dispute Resolution (EU ODR) (http://ec.europa.eu/odr) for your complaint. This portal can be relevant when living in another EU Country. When filling in a complaint please include our email address info@kinship-collective.com.
